If you are a property owner who doesn't want to sell your property, a corrupt entity may try to maliciously prosecute you in order to damage your life...Then you decide to sell, either because you are afraid, you have lost your business, or you just are fed up & give up...Damaging malicious prosecution can even involve someone calling the police & reporting that you are doing something illegal...Even if you are not, they have to show up on the premises, which is scary, for both you & your clients...Or, someone can file a malicious lawsuit against you on trumped up charges that don't exist, the damage to your reputation can kill your career hopes- even if nothing they say is true...
Mental Distress is another legal term to learn...If you are an artist tenant who is being evicted so condos can be built on your home, you can choose to fight...You may get some relocation renumeration, but the cost in mental distress is high...Know this, even if you do get relocation monies, after a long fight, you can also get compensation for the "mental distress" that they caused over the years of the legal fight to get what is your right...
If the new property owner has made you claw & fight & struggle for a proper relocation settlement, instead of just offering it to you at the beginning, they have caused you mental distress...Under Supreme Court Law, even if you get some relocation money you can also get a chunk of funds for that mental distress...
If we all fight back for our rights, we can stop the rampant eveicting of low income tenants to build these high rise condo buildings in Toronto...
Each person who chooses to fight & get money back will make this war unprofitable for corrupt foreign monies who don't care about who they throw out...

news: Beckett Gallery has succumbed to the construction ruin of business by deciding to close its doors...This is a very old business, once owned by his father...I really think they should get some compensation for the ruining of this gallery...(On Scollard street)
-Drabinsky Galllery decided to move to Yorkville because of the construction on Scollard...Another reputable galllery...Did they get compensation from the developers? Oh get real people, if you don't fight for your rights you don't get them...Of course not...
...update: so now they are drilling the cracks in our parking garage again, for the next 3 weeks...it's like being at the dentist daily...oh & our neighbours are getting their concrete balconies sanded & drilled too, same time...I can taste the concrete dust...Oh Joy!
So...I was showing at a great location called Studio 99 Cafe & Gallery at the corner of Yonge & Davenport...Someone bought the strip of land across the street at Scollard & Yonge & the city approved the density increase & soon contsruction dust & noise & vibration & trucks arrived to remove trees & park & generally screw up the karma of the neighbourhood...The 5 year old Studio 99 business, with its noble family fresh from Djibouti, could not handle the loss of customers caused by construction upset, & closed...2004...( A condo building built by Shiu Pong now sits across the street, the park has not been replanted yet...the pigeons wait...)
In 2005, I participated in a grand opening show with The Scollard Street Gallery, on the other side of Davenport, nearer to Hazelton lanes...Well gosh darn, all of a sudden, someone decided that that side of Scollard street sure needed some new condos too, so wham, soon after the June opening, construction began...Well, a couple of weeks in, my mother refused to stop by the gallery for a visit, stating that why would anyone want to go on that street now, it's all just noise & dust & construction...Hmmm. If my own mother didn't want to stop by...Scollard Street gallery closed finally march 2009, but the business actually ended when construction began...This time, I left the gallery before it shut down, from experience- but I still had to start brand new with new people & I lost all the people who had come to the grand opening...sigh.
So...I decided to go far away from downtown...I ended up this summer, hopeful to work with a new gallery at Yonge street north of Eglinton...As I awaited call to prepare for a show, lo & behold, the sidewalks along Yonge street apparently needed fixing...As I negotiated around orange cones & dirt & temporary fencing, I wondered how anyone could possibly access an art gallery in this mess...Sure enough, when I got to Dessinee Gallery on foot, with much difficulty, I no longer wondered why I hadn't heard from them- they were gone...This was in August 2009...
Now these are not all the galleries I have shown with in the past decade...These are 3 that closed specifically because of construction...
Lanes Gallery closed because the owner was Persian & in 2004, collectors were still freaked out by anyone who looked like the 9/11 guy photos- he lost because of his race...
The Kohl Gallery closed because his gallery was situated on a slope, apparently a neighbouring business said that for some reason no one was able to make a go of that particular location- maybe it was the slope...? Well, something geographical- all the previous businesses on that same spot had failed before...(you think someone might have checked this before leasing the spot?)
I digress. Construction & zoning density approvals & city councillors approving developments have really contributed to the fact that 16 years into my professional life as an artist, I am not in a stable economic situation...So... I was wondering, does anybody know how I could get some renumeration for loss of income from the city who keeps approving lousy high rise condo developments right beside my galleries???
